Pursuant to Article IX of the United Mine Workers of America 1950 Benefit Plan and Trust, the Trustees have reviewed your Request for an Advisory Opinion concerning the level of health benefits coverage for medical services provided to eligible employees under the Employer’s Benefit Plan.

Because the Trustees have not been provided with evidence of an actual dispute between an employee and his employe concerning the level of health benefits coverage as established by the National Bituminous Coal Wage Agreement of 1981, there are no issues for the Trustees to address under the authority of an exemption granted to us by the United States Department of Labor. We have no alternative but to dismiss this case.
