Re: Opinion of Trustees Resolution of Dispute

Pursuant to Article IX of the United Mine Workers of America 1950 Benefit Plan and Trust, and under the authority of an exemption granted by the United States Department of labor, the Trustees have reviewed your Request for Advisory Opinion concerning whether inpatient physician’s visits are subject to co-payment under the terms of your Employer Benefit Plan.

Article III. A. (3) (g) and Article III. A. (8) of your Employer’s Benefit Plan provide that in- hospital physician’s visits are subject to co-payments by the Beneficiary. Therefore, you are responsible for co-payments for the physician’s visits to your daughter during her hospitalization.
