Re: Opinion of Trustees
Resolution of Dispute
Case No. 81-5

Pursuant to Article IX of the United Mine Workers of America Benefit Plan and Trust, and under the authority of an exemption granted by the United States Department of Labor, the Trustees have received a question concerning the coverage of charges for chiropractor services.

Under Article III. A. 3 (p) 1 of your Employer’s Benefit Plan, charges for services rendered by a chiropractor are specifically excluded from coverage and were excluded under the former Plan.

Since this service is not a covered benefit under your Employer Plan, your Employer is not responsible for the provision of benefits for chiropractic services.

Sincerely,
