Pursuant to Article IX of the United Mine Workers of America 1950 Benefit Plan and Trust, and under the authority of an exemption granted by the United States Department of Labor, the Trustees have reviewed the facts and circumstances of this dispute concerning benefits for reversal of tubal ligation. Their opinion is issued in Question and Answer form as follows:
Subject: Reversal of Tubal Ligation
Reference:Article III, Section A (10)(a) 14 of the Employer’s Plan; 1978 Contract Q & A #50.
Question: Will benefits be provided for reversal of tubal ligation or other procedures for reversal of sterilization?
Answer: No. Since vasectomy reversal is specifically excluded from coverage, reversal of tubal ligations or other procedures for reversal of sterilization will not be covered benefits.
