Resolution of Dispute
Case No. 81-87
Pursuant to Article IX of the United Mine Workers of America 1950 Benefit Plan and Trust, and under the authority of an exemption granted by the United States Department of labor, the Trustees have reviewed your Request for Advisory Opinion concerning the commencement of the co-payment year under the terms of your Employer’s Benefit Plan.
Article III. A, (8) of the Employer’s Benefit Plan states that the co-payment year shall be a 12-month period commencing on the following dates: March 27, 1981, March 27, 1982, March 27, 1983 and March 27, 1984. Therefore the Employees are responsible for meeting the co-payments requirements with respect to benefits provided under the Employer’s Plan for the periods specified in the Plan.
